About These Terms
These Terms and Conditions apply to goods ordered from Fire Safety Store North West through our website, by email, by telephone or through an agreed quotation. References to “we”, “us” and “our” mean Fire Safety Store North West. “You” and “your” mean the person or business placing the order.
Please read these terms before ordering. By submitting an order, you confirm that you have checked the order details and agree to these terms. If you are purchasing as a consumer, nothing in these terms removes or limits your statutory rights.
Products & Specifications
We supply fire doors, frames, fire-rated ironmongery, glazing and associated products. Product descriptions, drawings, photographs, finishes and measurements are provided to help identify the goods. Images and screen colours are illustrative; natural veneer, laminate, paint and other finishes may have reasonable variations in colour, grain and appearance.
You are responsible for checking that the product, fire rating, configuration, dimensions, handing, frame depth, finish, glazing and ironmongery selected are suitable for the intended opening and project requirements before ordering.
We may make minor changes required to comply with law, certification or safety requirements, provided those changes do not materially reduce the product's function or quality.
Orders & When a Contract Is Formed
Your basket, enquiry, submitted configuration or payment is an offer to purchase. An automated acknowledgement only confirms that we have received the order; it does not by itself mean that the order has been accepted.
A contract is formed when we send written confirmation accepting the order. We may decline an order before acceptance, for example where goods are unavailable, information or pricing is incorrect, delivery cannot be arranged, payment is not authorised, or the requested specification cannot be manufactured or certified.
Please contact us immediately if an acknowledgement or confirmation contains an error. Changes are only agreed when confirmed by us in writing and may affect price and lead time.
Made-to-Requirement Orders
Fire doors ordered through “Build Your Fire Door”, or otherwise manufactured or finished to measurements or choices supplied by you, are made to your requirements. You must check all dimensions and specifications before submitting the order. We are not responsible for goods not fitting or being unsuitable where they have been produced correctly to the information you supplied.
Once manufacture, cutting, glazing, finishing or procurement of a bespoke item has started, requested changes may be impossible or may involve an additional charge and revised lead time.
Prices & Payment
The price payable is the price shown or quoted when the order is placed, subject to correction of obvious errors before acceptance. Delivery charges and any agreed additional services are shown separately or confirmed before the order is completed.
Payment must be received in cleared funds before goods are manufactured, ordered from a supplier or dispatched, unless we have expressly agreed credit terms in writing. Card payments may be processed securely by a third-party payment provider; we do not receive your complete card details.
Delivery
Delivery availability, charges, estimated lead times and arrangements depend on the goods, quantity, size, weight and destination. Details provided at checkout, in a quotation or in our order confirmation form part of the contract.
Manufacturing and delivery dates are estimates unless we expressly agree a guaranteed date in writing. We will contact you if we become aware of a material delay. Where you are a consumer, goods will be delivered within the period agreed with you or, if no period has been agreed, within the period required by law.
You must provide a complete and accurate delivery address, contact details, safe access and any relevant site restrictions. Additional reasonable charges may apply if delivery cannot be completed because nobody is available, access is unsafe or unsuitable, or information supplied by you is incorrect.
See our Delivery Information page for further delivery details. If there is any conflict, the written terms agreed specifically for your order will take priority.
Checking Your Delivery
Please inspect the packaging, quantities and visible condition of the goods as soon as reasonably possible. If there is visible damage, note it on the courier's delivery record where possible, keep all packaging and take clear photographs before moving or unpacking the goods further.
Tell us promptly about damage, missing goods or an incorrect item and provide the order reference, affected item details and photographs. Do not install, alter, paint, cut or dispose of a product that may be damaged or incorrect while we investigate, unless we tell you otherwise.
Signing a delivery record does not remove a consumer's legal rights. For business customers, any separate inspection and reporting deadline must be included in the final business terms or quotation.
Cancellation & Returns
If you are a consumer buying a standard, non-bespoke product at a distance, you normally have 14 days after receiving the goods to tell us that you wish to cancel, followed by a further 14 days to return them. Exceptions apply, including goods made to your specifications or clearly personalised.
Returned goods must be looked after while in your possession. We may make a deduction where handling beyond what would reasonably be permitted in a shop has reduced their value. Unless the goods are faulty or we agree otherwise, you are responsible for arranging and paying the return cost.
Eligible refunds will include the basic outbound delivery charge where required by law. Any extra amount paid for an enhanced delivery option is not refundable beyond the cost of our least expensive standard option. Refunds are made using the original payment method unless agreed otherwise.
Full practical instructions, the return address and any applicable collection arrangements will appear in our Returns & Cancellations Policy once finalised.
Faulty, Damaged or Incorrect Goods
We are responsible for supplying goods that conform to the contract. Consumers may have legal rights to reject, repair, replacement, price reduction or refund where goods are faulty, not as described or not fit for their normal or specifically agreed purpose.
We may ask for reasonable evidence and an opportunity to inspect the goods before providing a remedy. We are not responsible for faults caused after delivery by incorrect storage, handling, installation, alteration, misuse, failure to follow instructions, normal wear, unsuitable site conditions or work carried out by others.
Nothing in these terms limits any remedy that cannot legally be limited.
Our Responsibility
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of rights that cannot lawfully be excluded, or any other liability that the law does not allow us to exclude.
For consumers, we are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, was caused by inaccurate information or an act or omission by you, or relates to business use.
If you purchase wholly or mainly for business purposes, additional business-to-business limits of liability may need to be agreed and added to the final version of these terms.
Website Use
Website content is provided for general product and purchasing information. We aim to keep it accurate but may update products, specifications, availability and prices. Product content is not a substitute for project-specific fire-safety, design, surveying, certification or installation advice.
Unless stated otherwise, the website's text, branding, graphics, configurator and other content belong to us or our licensors and may not be copied, republished or commercially exploited without permission.
General Terms
Events outside our control
We are not responsible for delay or failure caused by events outside our reasonable control. We will take reasonable steps to reduce the effect and will contact you where your order is materially affected. Consumer rights relating to serious delay remain unaffected.
Personal information
We use personal information to process orders, take payment, arrange manufacture and delivery, provide customer service and meet legal obligations. Further details should be set out in our Privacy Policy.
Changes to these terms
The version in force when your order is accepted applies to that order, unless a change is required by law or agreed with you.
Severability and waiver
If any provision is found invalid or unenforceable, the remaining provisions continue to apply. A delay in enforcing a right does not waive that right.
Third-party rights
Only you and we may enforce the contract, except where the law expressly provides otherwise.
Governing law
These terms and contracts made under them are governed by the laws of England and Wales. Consumers may also benefit from mandatory rights and may bring proceedings in the courts available to them under applicable law.
